Investing.com can reveal that Alpha Modus has filed a lawsuit against advertising technology company MNTN Inc., accusing it of infringing three patents covering artificial intelligence–powered retail and marketing systems.
The complaint, filed in the U.S. District Court for the Western District of Texas and seen by Investing.com, alleges MNTN’s connected TV advertising platforms, including products such as MNTN Matched, Verified Visits, and Next Gen TV, infringe on Alpha Modus’s patented methods.
These patents, issued between 2019 and 2024, are said to cover systems that monitor consumer behavior, analyze interactions in real-time, and deliver targeted promotions and advertising.
Alpha Modus claims MNTN’s offerings leverage demographic, sentiment, and behavioral data in ways that directly overlap with its intellectual property.
According to the filing, the accused products “significantly contributed to the efficiency and profitability of CTV advertising utilized by Defendant’s customers” while causing Alpha Modus “lost business opportunities, revenue, and diminution of the value of its patented technology.”
William Alessi, CEO of Alpha Modus, told Investing.com the company’s litigation strategy balances enforcement with potential collaboration.
“Every infringement, and every infringer, is also a potential ally,” Alessi said. “We file these lawsuits to protect our shareholders and the integrity of our technology. But as we’ve consistently demonstrated, our preference is always to resolve matters quickly and amicably. We welcome the opportunity to turn adversaries into allies.”
Alessi added that Alpha Modus’s patented AI systems are “becoming ubiquitous in retail and advertising,” making disputes with companies in sectors such as connected TV and fintech increasingly likely.
“We are fully prepared to defend our intellectual property while remaining open to collaborations that accelerate growth and innovation,” he told Investing.com.
